We are an independent, boutique firm that has tremendous real-world experience in defending assets for our clients as their trustees, as well as overseeing a full team
of professionals in the planning of our client's defensive bulwarks*.
It all started nearly two decades ago when we began protecting disabled & elderly residents of group and assisted living homes through the
innovative use of trusts. By titling the properties in trusts, we were able to take full advantage of the IRS Code and provide ownership rights & tax incentives to shared group home residents. We even
borrowed & purchased homes on their behalf within the trusts themselves with no personal liability to the beneficiaries of the trusts.
Later, we used the same principles to secure investments &
housing through a mix of trusts, owner financing & arbitrage principles for debt and equity structuring.
One day a friend approached us stating that despite nearly a
billion dollars of property development, that he simply “was not able to sleep at night” due to the stress of knowing that everything he had built for his family was at risk ... and ripe for attack.
So, as a favor, we used our
unique, innovative & specialized knowledge of Creditor collection strategies to assist in managing the plans for their asset protection & estate planning.
After successfully assisting them weather ALL kinds of unexpected twists and turns, they encouraged us to help others.
Frankly, after many encouraging
discussions, and knowing that what we did could help many other vulnerable families, we agreed to share our skills and successes with a wider audience.
Although we still limit our services as a boutique practice,
we still have the ability to offer a select clientele the ability to begin protecting their assets from pre-planning strategy sessions up to lawsuits & court actions, if needed*. Knowing
that your future is far more secure than it would have been, this allows you to sleep much better at night!
*TMS often uses specialized legal & tax counsel in the affected client's state, that we may also oversee, together with the client. We also often use outside counsel for most specific Trust matters and drafting
of Delaware Trust documents.
